Definitions
1. COMPANY/US/WE means Simply Plastics Limited (company number 08372434) whose registered office is at UNIT L RADFORD BUSINESS CENTRE, RADFORD WAY, BILLERICAY, ESSEX, CM12 0BZ.
2. BUYER/YOU means the person(s), firm or company entering into the CONTRACT to purchase Goods from the Company.
3. CONTRACT means any contract between the COMPANY and the BUYER for the sale of GOODS.
4. GOODS means the products (including any installment of the GOODS or any parts for them) which the COMPANY is to supply in accordance with these conditions.
5. DELIVERY POINT means the place where the delivery of GOODS is to take place.

Every time you place an order with us you will be asked to agree to these Terms and Conditions which will form the basis of the contract between us - this will replace any existing contract between us.

or general information only and is not intended to amount to advice on which you should rely. We therefore disclaim all liability and responsibility arising from any reliance placed on such Content by any visitor to our site, or by anyone who may be informed of any of the Content.
Although we use our reasonable efforts to update the content, we make no representations, warranties or guarantees, whether express or implied, that the Content is accurate, complete or up-to-date.
The images of the Products on our site are for illustrative purposes only. Whilst we have made every effort to display the colours accurately, we cannot guarantee that your computer's/device's display of the colours accurately reflect the colour of the Products. Should you require exact colour codes for any of our products you should Contact us.
We reserve the right to amend the specifications of the products if required.

Product pricing

On our website we have implemented a real-time quote facility to provide you with accurate prices based on the type, size and specification of your required material. Whilst we have made every effort to ensure that the prices quoted are accurate, we reserve the right to cancel any order that contains products for which the price was incorrectly quoted. In this event the buyer will first be contacted to request additional payment. The buyer has the right to cancel the order in this event.

Product prices may change from time to time but any changes will not affect any order which we have confirmed by means of a confirmation email.
Placing an order

You can purchase our products by proceeding through our secure checkout pages.
It is your responsibility to ensure that all product specifications, personal and delivery information provided to us is correct at the point of placing the order.
You can pay for your order using a debit or credit card.
Unless otherwise agreed full payment for the order will be taken in advance of accepting your order.
After you place an order you will receive an email from us acknowledging that we have received your order. The contract between us will only be formed when we send you this email.
If we are unable to provide you with a product (in the event that the product is not in stock or is no longer available) we will inform you of this by email. You will be given the choice of amending or cancelling your order. In the event of cancelling your order we will refund you the full amount as soon as possible.

Delivery

We will make every effort to deliver your order within our estimated delivery times (see Delivery).
The estimated delivery dates are calculated from the day the order was placed if ordered before 1pm Monday to Friday, or on the following working day if ordered after 1pm or on a weekend/bank holiday.
Any dates specified by the Company for delivery of goods are intended to be an estimate. If no dates are specified delivery will be within a reasonable time.
Subject to the other provisions of these conditions the Company will not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, loss of profits, loss of business, depletion of goodwill and like loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods (even if caused by the Company’s negligence), nor will any delay entitle the Buyer to terminate or rescind the Contract unless such delay exceeds 180 days.
Delivery will be completed when we deliver the order to the address you provided whilst placing the order.
The products will be your responsibility from the completion of delivery.
Most deliveries will require a signature. If no-one is available at the delivery point to take delivery we will where possible leave the products in accordance with your additional delivery instructions, however our compliance with any delivery instructions that you provide cannot be guaranteed. If we are unable to deliver the order to you in the event that no-one is available to take delivery, or the address you provided during the order process was incorrect we will try to leave a failed delivery note if possible. You will need to contact us to rearrange delivery for which you will be responsible for any additional delivery costs.
If the Customer's order has not been delivered within 14 days of the order being dispatched (customer notified via email) then the Customer must notify us immediately via email or telephone (see Contact information). Failure to do so may prevent the Customer from being eligible for a replacement.

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material we publish on it (the “Content”). Those works are protected by copyright laws and treaties around the world. All such rights are reserved and unless otherwise specified, the authors of such works asserts their moral right under Chapter 4 of the Copyright, Designs and Patents Act 1988 to be identified as the author of the relevant works.

You may print off one copy, and may use small quotations extracted of any page(s) from our site for your personal use provided you acknowledge the appropriate site (and author) and provide a link back to the original source. You must not use any part of the Content on our site for commercial purposes without notifying us of your intentions and obtaining a licence to do so from us or our licensors.

You must not modify the paper or digital copies of any Content you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

If you print off, copy or download any part of our site in breach of these Terms of Use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
Liability disclaimer

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude all conditions, warranties, representations or other terms which may otherwise apply to our site or any content on it, whether express or implied.

If you are a business customer we only supply products for internal use by your business and you agree not to use the products for any re-sale purposes.

We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

Jurisdiction and applicable law

If you are a consumer, please note that the Terms, their subject matter and the formation of any relationship or contract between you and us, are governed by English law. You and we both agree to that the courts of England will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

If you are a business, these Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England. We both irrevocably agree that the courts of England shall have non-exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
